OVERVIEW
The terms “we”, “us” and “our” refer to Whiskers Therapy LLC. Whiskers Therapy LLC operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the “Services”).
These terms, together with any policies referenced in them (these “Terms of Service” or “Terms”), describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, including warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access our Services.
SECTION 1 – ACCESS AND ACCOUNT
By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, and that you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including browsing our store or purchasing any of our products, you may be asked to provide certain information, such as your email address and billing, payment and shipping information. You represent and warrant that all the information you provide is correct, current and complete, and that you have all rights necessary to provide it.
You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.
SECTION 2 – OUR PRODUCTS
We have made every effort to show our products accurately. However, colors and product appearance may differ from how they appear on your screen, depending on your device and its settings.
We do not warrant that the appearance or quality of any product will meet your expectations or be identical to how it is shown in our store.
All product descriptions are subject to change at any time without notice, at our sole discretion. We may discontinue any product at any time and may limit the quantities of any product we offer to any person, region or jurisdiction, on a case-by-case basis.
SECTION 3 – ORDERS
When you place an order, you are making an offer to purchase. Whiskers Therapy LLC may accept or decline your order for any reason. Your order is not accepted until we confirm it, and we must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests once an order is in production. If we decline, change or cancel an order, we will try to notify you using the email, billing address or phone number provided with the order.
Your purchases are eligible for replacement or refund only as described in our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 – PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed, as shown in your order confirmation email. Unless otherwise stated, posted prices do not include taxes, shipping, handling, customs or import charges.
We may offer promotions from time to time that are governed by their own terms. If the terms of a promotion conflict with these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases, and to promptly update it so we can complete your transactions and contact you as needed.
You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are authorized to use that payment method, (iii) charges you incur will be honored by your card issuer, and (iv) you will pay all charges you incur at the posted prices, including shipping and handling and all applicable taxes.
SECTION 5 – SHIPPING AND DELIVERY
All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing or events outside our control. Once we transfer products to the carrier, title and risk of loss pass to you. See our Shipping Policy and Refund Policy for how we handle lost or damaged packages.
SECTION 6 – INTELLECTUAL PROPERTY
Our Services, including but not limited to all trademarks, brands, text, designs, images, graphics, product reviews, video and audio, and their selection and arrangement, are owned by Whiskers Therapy LLC or its licensors and are protected by U.S. and foreign copyright, trademark and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any of the material on the Services without our prior written consent. Nothing in these Terms grants you a license to any intellectual property of Whiskers Therapy LLC or any third party. All rights not expressly granted are reserved.
Whiskers Therapy LLC’s name, logos, product names, designs and slogans are trademarks of Whiskers Therapy LLC. You must not use them without our prior written permission. All other names, logos and trademarks on the Services belong to their respective owners.
SECTION 7 – OPTIONAL TOOLS
We may give you access to tools provided by third parties, which we neither monitor nor control. We provide such tools “as is” and “as available”, without warranties of any kind and without endorsement, and we have no liability arising from your use of them. Your use of optional third-party tools is entirely at your own risk, and you should make sure you are familiar with and approve of the terms on which they are provided.
Any new features or tools we add to the Services in the future are also subject to these Terms.

The Services may contain links to websites operated by third parties. We are not responsible for the content or accuracy of third-party websites, and you visit them at your own risk. We are not liable for any harm or damages related to your use of third-party websites or anything you buy from them. All personal information we collect through the Services is subject to our Privacy Policy. By using the Services, you acknowledge that you have read it.

If you submit any ideas, suggestions, feedback, reviews, photos or other content (“Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display that Feedback in any medium for any purpose, including commercial use.

We may, but are not required to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that violates anyone’s intellectual property or these Terms.
You agree that your Feedback will not violate any third party’s rights, will not contain unlawful, abusive or obscene material or any malicious code, and will not be submitted under a false email address or false identity. You are solely responsible for your Feedback and its accuracy.

Information on the Services may occasionally contain errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct any of these, and to change information or cancel orders if information is inaccurate, at any time without prior notice, including after you have submitted your order.

The sections on Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law and Privacy Policy, and any other provisions that by their nature should survive, continue to apply after termination.

Information on the Services is provided for general information only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.
EXCEPT AS EXPRESSLY STATED BY WHISKERS THERAPY LLC, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THEM ARE PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT ANY REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.
SECTION 15 – LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL WHISKERS THERAPY LLC OR ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA OR REPLACEMENT COSTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM, EVEN IF ADVISED OF THEIR POSSIBILITY.

You agree to indemnify, defend and hold harmless Whiskers Therapy LLC and its owners, officers, employees, agents, contractors, licensors and service providers from any losses, damages, liabilities or claims, including reasonable attorneys’ fees, payable to any third party due to or arising out of (1) your breach of these Terms, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed. This will not affect the validity or enforceability of the remaining provisions.
SECTION 18 – WAIVER; ENTIRE AGREEMENT
Our failure to exercise or enforce any right or provision of these Terms does not waive that right or provision. These Terms and any policies we post on this site are the entire agreement between you and us regarding the Services and replace any prior agreements or communications, including prior versions of these Terms.

You may not transfer or assign these Terms or any of your rights or obligations under them without our prior written consent. We may transfer or assign these Terms without your consent or notice to you.
SECTION 20 – GOVERNING LAW
These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-law rules. You and Whiskers Therapy LLC consent to the jurisdiction of the state and federal courts located in Oregon.
